What kind of spider is this?

The body is over an inch long, I'd guess.

It looks like a black and yellow garden spider. They will bite but it is not poisonous.

looks like a writing spider...........tell the spider your name and the next day it will write your name in the center...so grandma says

Garden Spider.........We use to as kids take grasshoppers and throw them in the web, the spider will quickly attack it and spin a web around it. Its really cool to watch. Harmless to humans but great addition to your garden. They will take care of your pest problem.
